TERMS AND CONDITIONS OF SALE

B&B ARTIGIANA SRL, a company based at Via Pilata 48 – 23887 Olgiate Molgora (Lecco) – ITALY, Email: info@bbartigiana.it – Certified email: bbartigiana@pec.it – VAT no. and Tax Code 03422390132, makes it possible for all users to purchase the company’s exclusive products through its website, www.bbartigiana.it.

Accessing this website, the sale of products and online contracts with B&B ARTIGIANA are subject to accepting the terms and conditions of sales indicated below.

1 – ACCEPTANCE OF THE TERMS AND CONDITIONS OF SALE

A contract between B&B ARTIGIANA and a customer is only finalised upon acceptance, even partial, of an order by B&B ARTIGIANA, which reserves the right, at its sole discretion, to accept orders.  Such acceptance is understood to be tacitly granted unless a customer is otherwise informed within 6 days of receipt of an order. By placing an order using one of the ways offered, a customer indicates that all of the information provided during the online purchase process has been read and complete acceptance of the terms and conditions of sale and payment indicated herein.
Should the customer be an final consumer (i.e. a natural person who is making a purchase for non-business reasons), then once the online purchase procedure has been completed, that customer must print, save an electronic copy or in some form keep these Terms and Conditions of Sale, in compliance with Artile 50 et seq. of Legislative Decree no. 206/05, which is the Italian Consumer Code for remote purchases.

2 – METHOD OF PURCHASE

A customer may purchase the products found in the online catalogue available at www.bbartigiana.it at the time an order is sent (the catalogue can be seen on the website in the shop section), as per the descriptions provided on the product information sheets. The technical information provided on the website faithfully reflects that of the actual products and that of any third-party products that might be included in the catalogue. B&B ARTIGIANA reserves the right to amend the technical information, without notice, about its products to ensure it matches the company’s own production standards and those of third-party manufacturers. Any pictures provided with an information sheet might not perfectly represent the characteristics of a product and might differ in terms of size and colour to the item shown. B&B ARTIGIANA shall confirm it has correctly received an order by sending an email in response to the email address provided by the client on the purchase form. This confirmation message shall indicate the date of receipt and the order number to be used in any further communication with B&B ARTIGIANA. The message will also indicate all the information provided by the customer, which agrees to check the information is correct and promptly inform B&B ARTIGIANA about any corrections, using the methods indicated in this document. Should an order not be accepted, B&B ARTIGIANA undertakes to inform the customer within 6 days of receiving the order. If payment has been made in advance using a credit card or bank transfer,  then this shall be returned within 30 days of receipt of payment.

3 – PRICE AND INVOICES

The prices in our shops are shown in Euros, without VAT. Our prices do not include any customs or other duties payable to the customs offices in foreign countries.

For shipments in Italy, Italian VAT is applied.

For shipments within the EU and to Northern Ireland:

• If the customer has an EU VAT no. and is registered in the VIES database, the transaction will not be subject to VAT and it is the customer’s responsibility to pay the applicable VAT in the destination country using the reverse charge mechanism. In such cases, the VAT no. must be provided in advance.
• If the customer does not have an EU VAT no. or does have a VAT no. but is not registered in the VIES database, then Italian VAT is applied.

For shipments to outside the EU: such transactions are not subject to VAT. The customer is responsible for paying any customs or other duties in the destination country.

The prices applied for any products ordered are those in effect on the day the purchase order is issued. B&B Artigiana retains ownership rights for any goods delivered until such time as full payment is made of the invoice/receipt and any shipping and customs costs.

4 – WARRANTIES AND RIGHT OF WITHDRAWAL

Pursuant to article 54 et seq. of Legislative Decree no. 205/2005, a customer that is deemed to be a consumer (i.e. a natural person who purchases goods for non-business purposes, that is, does not provide B&B ARTIGIANA with a VAT no. on the purchase form) has the right to withdraw from the purchase agreement within 14 days of receiving the product, for any reasons whatsoever and without any penalties. All our products are sent free from any defects or faults inherent to the product itself;  should a customer find any such defects or faults, it must report this to B&B ARTIGIANA in a registered letter or certified email within 10 days of delivery.

All of our customers have the right, without the imposition of any penalty, to withdraw from the contract in accordance with the provisions of article 5 of Legislative Decree no. 185 of 22 May 1999, as amended and integrated. This means it is possible to return the product, thus withdrawing from the contract without any need to provide reasons, by communicating this within 10 days of receiving the product. Such notification must be done by a registered letter sent to B&B ARTIGIANA and will result in the product being replaced or the refund of any amounts paid. B&B ARTIGIANA shall only and exclusively accept products returned in perfect condition in their original packaging, along with the documentation proving purchase. The only costs the customer will be required to pay are the shipping costs for the return, provided the product is returned in compliance with what is indicated above. B&B ARTIGIANA shall refund the entire amount already paid to the customer, net of the transport fees, within 30 days of receiving the notice of withdrawal and once it has received and checked the return product. This refund will be done by cancelling the amount paid by credit card or via bank transfer. In this case, the customer must promptly inform B&B ARTIGIANA of the details of the banks account for the refund (IBAN for the person who made the order). The right of withdrawal ceases completely if the product is not integral (package and/or content).

5 – PAYMENT METHODS

The following payment methods are accepted:

• CREDIT CARDS USING THE NEXI SYSTEM (VISA – MASTERCARD – MAESTRO)
• BANK TRANSFER PRIOR TO SHIPMENT

Should bank transfer prior to shipment be the chosen payment method, then the order will only be shipped once B&B ARTIGIANA has effectively received the payment in its current account.  Payment must be made within 5 working days of the date on which the order is accepted. If payment is not made within this period, then the order shall be automatically cancelled.

The bank details for making a bank transfer will be provided to the client in an email sent during the purchase process.

6 – SHIPPING TIMES AND METHODS

Shipping costs are calculated by the website when the order is made on the basis of the destination and weight of the goods.

Delivery is normally 3 to 5 days from receipt of the order. However, for orders to be delivered to the Vatican City, the Republic of San Marino, Livigno and Campione, delivery times might be longer.

Should any products ordered not be immediately available, B&B ARTIGIANA will contact the customer to agree on a delayed delivery. B&B ARTIGIANA uses leading express couriers for its deliveries, but this is no guarantee of occasional delays, for which the company cannot be held responsible.

Goods are always transported on behalf and at the risk of the buyer. Thus, B&B ARTIGIANA is not responsible for any deterioration, damage, delay or other harm of any kind that may occur during shipping.

When the goods are delivered by the courier, the customer must check the packaging is intact, undamaged, not wet or otherwise altered, including materials used to seal the package.

The courier must be immediately informed of any anomalies (meaning any damage to the packaging or a mismatch in the number of packages) and the shipment accepted with reserve. B&B ARTIGIANA must be informed within 2 days by registered mail with return receipt, having already phoned the company.

8 – JURISDICTION AND APPLICABLE LAW

The sales contract between B&B ARTIGIANA shall be understood to be entered into in Italy and governed by Italian law.

To resolve any civil or criminal disputes arising in relation to this sales contract entered into remotely, if the customer is a consumer, territorial jurisdiction shall be the competent court for his/her municipality of residence; in all other cases, the Lecco Court shall have sole territorial jurisdiction.

9 – USE OF THE WEBSITE

It is forbidden to provide false personal information and to engage in any conduct likely to cause confusion as to the personal identity of the user.

Users declare under their own responsibility that the data provided in the registration forms as well as any contact or sales details are true and relate to the person making the declaration. Users shall not use the shop or related services for any illegal purposes or purposes that are contrary to these terms and conditions of use. Likewise, users shall not interfere with others use of the shop or related service or use them in a manner which might impair their functionality, render them unusable, cause them to overload, or deteriorate.

Should use of online sales require user registration, then users agree to diligently keep their login details needed to access the shop.

10 – INTELLECTUAL PROPERTY

Editorial, graphic and web engineering content are protected by copyright and intellectual property law. Thus, it is strictly forbidden to reproduce any of the content on the website for commercial purposes or in any case in order to draw any benefit, unless prior written permission has been received from B&B ARTIGIANA.
